Dhara 304 – Punishment for culpable homicide not amounting to murder
हत् या की कोिट म न आन ᱶ वाल े आपरािधक मानव वध क े े िलए दण् ड—जो कोई ऐसा आपरािधक मानव वध करेगा, जो हत् या की कोिट मᱶ नहᱭ आता ह,ै यिद वह कायर् िजसके ᳇ारा मृत् यु कािरत की गई ह,ै मृत् यु या ऐसी शारीिरक क्षित, िजससे मृत् यु होना संभाव् य है, कािरत करने के आशय से िकया जाए, तो वह 1 [आजीवन कारावास] से, या दोनᲂ मᱶ से िकसी भांित के कारावास से, िजसकी अविध दस वषर् तक की हो सकेगी, दिण् डत िकया जाएगा और जुमार्ने से भी दण् डनीय होगा । अथवा यिद वह कायर् इस ज्ञान के साथ िक उससे मृत् यु कािरत करना सम् भाव् य ह,ै िकन् तु मृत् यु या ऐसी शारीिरक क्षित, िजससे मृत् यु कािरत करना सम् भाव् य ह,ै कािरत करने के िकसी आशय के िबना िकया जाए, तो वह दोनᲂ मᱶ से िकसी भांित के कारावास से, िजसकी अविध दस वषर् तक की हो सकेगी, या जुमार्ने से, या दोनᲂ से, दिण् डत िकया जाएगा ।
304क. उपक्षा ᳇ारा म े त् ृयु कािरत करना—जो कोई उतावलेपन से या उपेक्षापूणर् िकसी ऐसे कायर् से िकसी व् यिक् त की मृत् यु कािरत करेगा, जो आपरािधक मानव वध की कोिट मᱶ नहᱭ आता, वह दोनᲂ मᱶ से िकसी भांित के कारावास से, िजसकी अविध दो वषर् तक की हो सकेगी, या जुमार्ने से, या दोनᲂ से, दिण् डत िकया जाएगा ।
304ख. दहज म े त् ृयु—
(1) जहां िकसी स् तर्ी की मृत् यु िकसी दाह या शारीिरक क्षित ᳇ारा कािरत की जाती ह या उसक ै े िववाह के सात वषर् के भीतर सामान् य पिरिस् थितयᲂ से अन् यथा हो जाती ह और यह दिशत िकया जाता ह ै िक उसकी म ै ृत् यु के कुछ पूवर् उसके पित ने या उसके पित के िकसी नातेदार ने, दहज की िकसी मा े ंग के िलए, या उसके संबंध म,ᱶ उसके साथ कर्ूरता की थी या उसे तग िकया था ं वहां ऐसी मृत् यु को “दहज म े ृत् यु” कहा जाएगा और ऐसा पित या नातेदार उसकी मृत् यु कािरत करने वाला समझा जाएगा । स् पष्टीकरण —इस उपधारा के पर्योजनᲂ के िलए “दहेज” का वही अथर् ह जो दह ै ज पर्ितष े ेध अिधिनयम, 1961 (1961 का 28) की धारा 2 मᱶ ह ।ै
(2) जो कोई दहज म े ृत् यु कािरत करेगा वह कारावास से, िजसकी अविध सात वषर् से कम की नहᱭ होगी िकन् तु जो आजीवन कारावास की हो सकेगी, दिण् डत िकया जाएगा ।]

Whoever commits culpable homicide not amounting to murder, shall be punished with 1[imprisonment for life], or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine, if the act by which the death is caused is done with the intention of causing death, or of causing such bodily injury as is likely to cause death; or with imprisonment of either description for a term which may extend to ten years, or with fine, or with both, if the act is done with the knowledge that it is likely to cause death, but without any intention to cause death, or to cause such bodily injury as is likely to cause death.
304A Causing death by negligence
Whoever causes the death of any person by doing any rash or negligent act not amounting to culpable homicide, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
304B Dowry death
(1) Where the death of a woman is caused by any burns or bodily injury or occurs otherwise than under normal circumstances within seven years of her marriage and it is shown that soon before her death she was subjected to cruelty or harassment by her husband or any relative of her husband for, or in connection with, any demand for dowry, such death shall be called “dowry death”, and such husband or relative shall be deemed to have caused her death. Explanation.—For the purposes of this sub-section, “dowry” shall have the same meaning as in section 2 of the Dowry Prohibition Act, 1961 (28 of 1961).
(2) Whoever commits dowry death shall be punished with imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life.]
